Mb\u00ebshtetur nga qeveria e Mbret\u00ebris\u00eb s\u00eb Bashkuar dhe zbatuar nga Qendra AIRE dhe Iniciativa Rajonale Kund\u00ebr Korrupsionit, ky projekt promovon nj\u00eb bashk\u00ebpunim m\u00eb t\u00eb madh rajonal p\u00ebr konfiskimin dhe kthimin e pasurive. Hapat e fundit t\u00eb nd\u00ebrmarra n\u00eb kuad\u00ebr t\u00eb projektit ishin krijimi i Rrjetit Rajonal t\u00eb Ekspert\u00ebve t\u00eb Kthimit t\u00eb Pasurive dhe platform\u00ebs n\u00eb internet p\u00ebr shk\u00ebmbimin e informacionit n\u00eb k\u00ebt\u00eb fush\u00eb. Koordinatorja Mandija v\u00eb n\u00eb dukje shum\u00eb zhvillime pozitive lidhur me aksesin ndaj kthimit t\u00eb pasurive n\u00eb Shqip\u00ebri.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cShqip\u00ebria ka tani SPAK-un (Struktura e Posa\u00e7me kund\u00ebr Korrupsionit dhe Krimit t\u00eb Organizuar), Gjykat\u00ebn e Posa\u00e7me kund\u00ebr Korrupsionit, t\u00eb cilat u krijuan si pjes\u00eb e nj\u00eb strukture t\u00eb ve\u00e7ant\u00eb p\u00ebr hetimin, ndjekjen penale dhe gjykimin e \u00e7\u00ebshtjeve t\u00eb korrupsionit dhe krimit t\u00eb organizuar, si rezultat i paket\u00ebs s\u00eb reform\u00ebs kushtetuese n\u00eb vitin 2016, por zbatimi erdhi m\u00eb von\u00eb. Aktualisht, n\u00eb Shqip\u00ebri ekziston nj\u00eb kuad\u00ebr ligjor i plot\u00eb p\u00ebr nj\u00eb hetim t\u00eb plot\u00eb financiar funksional, ndjekjen penale dhe gjykimin p\u00ebr rastet e korrupsionit dhe t\u00eb krimit t\u00eb organizuar. Prokuroria e Posa\u00e7me ushtron ndjekjen penale dhe p\u00ebrfaq\u00ebson akuz\u00ebn n\u00eb em\u00ebr t\u00eb shtetit para Gjykatave t\u00eb posa\u00e7me, duke i kryer funksionet e saj n\u00eb m\u00ebnyr\u00eb t\u00eb pavarur, p\u00ebrmes prokuror\u00ebve t\u00eb posa\u00e7\u00ebm, t\u00eb cil\u00ebt em\u00ebrohen nga K\u00ebshilli i Lart\u00eb i Prokuroris\u00eb. BKH-ja (Byroja Komb\u00ebtare e Hetimit) \u00ebsht\u00eb nj\u00eb nj\u00ebsi e specializuar e policis\u00eb gjyq\u00ebsore q\u00eb heton veprat penale t\u00eb kryera nga zyrtar\u00eb qeveritar\u00eb dhe t\u00eb tjer\u00eb q\u00eb dyshohen q\u00eb jan\u00eb p\u00ebrfshir\u00eb n\u00eb vepra penale n\u00eb lidhje me krimin e organizuar dhe korrupsionin, n\u00ebn juridiksionin e Prokuroris\u00eb s\u00eb Posa\u00e7me sipas Ligjit p\u00ebr SPAK-un t\u00eb vitit 2016 (Ligji p\u00ebr Organizimin dhe Funksionimin e Institucioneve p\u00ebr t\u00eb luftuar Korrupsionin dhe Krimin e Organizuar). Prokuria e Posa\u00e7me dhe BKH-ja kan\u00eb ekspertiz\u00eb, por gjeneron edhe bashk\u00ebpunim institucional. \u00cbsht\u00eb shum\u00eb e r\u00ebnd\u00ebsishme q\u00eb institucionet tona t\u00eb punojn\u00eb p\u00ebr gjenerimin e statistikave efektive dhe t\u00eb ofrojn\u00eb mund\u00ebsi p\u00ebr trajnim t\u00eb kapaciteve q\u00eb punojn\u00eb n\u00eb k\u00ebt\u00eb fush\u00eb, si dhe bashk\u00ebpunim, shk\u00ebmbim informacioni dhe t\u00eb eksperiencave p\u00ebr kthimin e pasurive. Vet\u00ebm kjo qasje mund t\u00eb siguroj\u00eb efekte afatgjata n\u00eb k\u00ebt\u00eb fush\u00eb\u201d, n\u00ebnvizon Mandija.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Fal\u00eb mb\u00ebshtetjes s\u00eb qeveris\u00eb s\u00eb Mbret\u00ebris\u00eb s\u00eb Bashkuar dhe p\u00ebrpjekjeve t\u00eb k\u00ebtij projekti, n\u00eb Tiran\u00eb u organizua konferenca rajonale e ekspert\u00ebve t\u00eb kthimit t\u00eb pasurive n\u00eb mars t\u00eb k\u00ebtij viti, e cila \u00e7oi n\u00eb krijimin e nj\u00eb rrjeti q\u00eb do t\u00eb p\u00ebrqendrohet te shk\u00ebmbimi m\u00eb efikas i informacionit dhe praktikave n\u00eb Ballkanin Per\u00ebndimor.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cNe kemi zhvilluar kontakte t\u00eb forta dhe Qendra AIRE tani lidh institucionet dhe i inkurajon profesionist\u00ebt t\u00eb bashk\u00ebpunojn\u00eb n\u00eb funksion t\u00eb kthimit t\u00eb pasurive n\u00eb zbatim t\u00eb ligjit antimafia. Shqip\u00ebria duhet t\u00eb vazhdoj\u00eb t\u00eb forcoj\u00eb dialogun me fqinj\u00ebt tan\u00eb, pasi kjo \u00ebsht\u00eb e vetmja m\u00ebnyr\u00eb p\u00ebr t\u00eb luftuar me sukses korrupsionin dhe krimin e organizuar\u201d, thekson Mandija.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Legjislacioni p\u00ebr kthimin e pasurive n\u00eb Shqip\u00ebri \u00ebsht\u00eb i rregulluar nga ligji i posac\u00ebm antimafia si dhe Kodi Penal dhe Kodi i Procedur\u00ebs Penale, t\u00eb cil\u00ebt trajtojn\u00eb konfiskimin e zakonsh\u00ebm, duke mbuluar shkeljet me lidhje t\u00eb forta midis veprave penale dhe produkteve t\u00eb krimit. Konfiskimi i zgjeruar, nj\u00eb mas\u00eb ky\u00e7e p\u00ebr luft\u00ebn kund\u00ebr krimit t\u00eb organizuar dhe korrupsionit, trajtohet nga ligji antimafia, i cili \u00ebsht\u00eb ligj lex specialis.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cQ\u00ebllimi i ligjit antimafia, i cili zbatohet dhe p\u00ebr konfiskimin e zgjeruar, \u00ebsht\u00eb p\u00ebrcaktuar shprehimisht n\u00eb nenin 2 t\u00eb tij dhe p\u00ebrfshin parandalimin dhe luft\u00ebn kund\u00ebr krimit t\u00eb organizuar, trafikimit, korrupsionit dhe krimeve t\u00eb tjera n\u00ebp\u00ebrmjet konfiskimit t\u00eb pasuris\u00eb s\u00eb personave q\u00eb kan\u00eb nj\u00eb status t\u00eb pajustifikuar ekonomik q\u00eb rrjedh nga aktivitete t\u00eb dyshuara si kriminale. Dy kriteret kryesore p\u00ebr k\u00ebt\u00eb jan\u00eb statusi i pajustifikuar ekonomik dhe pjes\u00ebmarrja n\u00eb veprimtari kriminale. Ligji ofron nj\u00eb baz\u00eb p\u00ebr konfiskimin e pasurive t\u00eb ve\u00e7anta, vlera e t\u00eb cilave \u00ebsht\u00eb haptazi jo n\u00eb p\u00ebrpjestim me t\u00eb ardhurat e personit nga burimet e ligjshme; por edhe konfiskim t\u00eb \u00e7do pasurie tjet\u00ebr (monetare, t\u00eb luajtshme dhe t\u00eb paluajtshme) p\u00ebrve\u00e7 atyre q\u00eb i n\u00ebnshtrohen konfiskimit, n\u00eb kushtet q\u00eb k\u00ebto t\u00eb fundit jan\u00eb tjet\u00ebrsuar, shp\u00ebrb\u00ebr\u00eb, transferuar, fshehur apo zhvendosur\u201d, shton Mandija.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Me p\u00ebrvoj\u00ebn e saj t\u00eb p\u00ebrfaq\u00ebsimit t\u00eb Shqip\u00ebris\u00eb n\u00eb arbitrazhe nd\u00ebrkomb\u00ebtare dhe n\u00eb Gjykat\u00ebn Evropiane t\u00eb t\u00eb Drejtave t\u00eb Njeriut, koordinatorja Mandija n\u00ebnvizon r\u00ebnd\u00ebsin\u00eb e mbrojtjes t\u00eb standartit t\u00eb t\u00eb drejtave t\u00eb njeriut n\u00eb procedurat e zbatimit t\u00eb ligjit antimafia n\u00eb t\u00eb gjitha hapat e procesit nga hetimi, gjykimi dhe kthimi i pasurive apo administrimi i tyr\u00eb, n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb sigurohemi q\u00eb t\u00eb kemi kemi rezultate q\u00eb jan\u00eb n\u00eb interes t\u00eb publikut.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cNe duhet t\u00eb p\u00ebrmir\u00ebsojm\u00eb pun\u00ebn dhe bashk\u00ebpunimin e institucioneve nga fillimi deri n\u00eb fund, n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb kemi vendime t\u00eb form\u00ebs s\u00eb prer\u00eb q\u00eb n\u00eb fakt p\u00ebrfundojn\u00eb me konfiskim t\u00eb p\u00ebrhersh\u00ebm dhe p\u00ebrfundimtar t\u00eb pasuris\u00eb. Po flasim me ekspert\u00eb nga Shqip\u00ebria dhe presim me padurim \u00e7\u00ebshtje specifike q\u00eb mund t\u00eb p\u00ebrdoren si shembuj p\u00ebr trajnimin fillestar dhe vazhdues t\u00eb magjistrat\u00ebve dhe ekspert\u00ebve t\u00eb tjer\u00eb n\u00eb k\u00ebt\u00eb fush\u00eb. Ne e shohim progresin e b\u00ebr\u00eb fal\u00eb zbatimit t\u00eb masave t\u00eb nevojshme p\u00ebr funksionimin operacional t\u00eb SPAK-ut dhe pritet q\u00eb zbatimi i legjislacionit t\u00eb b\u00ebhet edhe m\u00eb i fort\u00eb n\u00eb t\u00eb ardhmen. Gjithashtu, Shqip\u00ebria \u00ebsht\u00eb p\u00ebrqendruar te nd\u00ebrtimi i ekspertiz\u00ebs p\u00ebr hetimet financiare. Institucionet tona kan\u00eb akses n\u00eb fonde t\u00eb ndryshme p\u00ebr trajnim dhe specializim. \u00cbsht\u00eb e r\u00ebnd\u00ebsishme q\u00eb organizata t\u00eb tilla si Qendra AIRE dhe RAI t&#8217;i njohin k\u00ebto hapa nd\u00ebrsa ecin p\u00ebrpara dhe t\u00eb inkurajojn\u00eb Ballkanin Per\u00ebndimor p\u00ebr reforma t\u00eb m\u00ebtejshme n\u00eb funksion t\u00eb interesit publik dhe forcimit t\u00eb shtetit ligjor n\u00eb Shqip\u00ebri\u201d, thekson Mandija.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Rrjeti Rajonal i Ekspert\u00ebve t\u00eb Kthimit t\u00eb Pasurive do t\u00eb p\u00ebrfshij\u00eb gjyqtar\u00eb, prokuror\u00eb dhe ekspert\u00eb ligjor\u00eb nga Shqip\u00ebria.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cVet\u00ebm bashk\u00ebpunimi i plot\u00eb rajonal mund t\u00eb siguroj\u00eb luft\u00eb efektive kund\u00ebr korrupsionit dhe krimit t\u00eb organizuar. Ne mund t\u00eb punojm\u00eb s\u00eb bashku p\u00ebr t\u00eb p\u00ebrmir\u00ebsuar qasjen ndaj hetimit financiar, krijimit t\u00eb sisitemit bashk\u00ebkohor dhe efi\u00e7ient t\u00eb t\u00eb dh\u00ebnave si dhe t\u00eb metodologjive t\u00eb mbledhjes, mbajtjes dhe qarkullimit sa m\u00eb t\u00eb mir\u00eb t\u00eb t\u00eb dh\u00ebnave. Kjo mund t\u00eb b\u00ebhet edhe n\u00ebp\u00ebrmjet p\u00ebrpjekjeve t\u00eb koordinuara nd\u00ebrmjet institucioneve t\u00eb Shqip\u00ebris\u00eb dhe institucioneve t\u00eb rajonit. Kjo \u00ebsht\u00eb e r\u00ebnd\u00ebsishme p\u00ebr t\u00eb bashk\u00ebpunuar dhe p\u00ebr ta b\u00ebr\u00eb m\u00eb t\u00eb v\u00ebshtir\u00eb largimin e pasurive dhe kriminel\u00ebve nga vendi dhe transferimin e pasurive. T\u00eb gjitha vendet e rajonit ndajn\u00eb t\u00eb nj\u00ebjtat probleme, t\u00eb nj\u00ebjtat \u00e7\u00ebshtje dhe sfida.
